Charging the Offense
Felonies
Felonies are charged by a document called an Information by the prosecuting attorney of the County where the crime was committed.
Misdemeanors
Misdemeanors are charged by one of three methods in District or Municipal courts of the State:
- The filing of the complaint by the prosecutor;
- The service of a citation and notice to appear by the prosecutor; and
- Initiation by citizen complaint.
U.S. Federal Courts
In U.S. Federal Court the methods are very much the same with certain crimes charged by citation and the more serious crimes charged by Information or by Grand Jury Indictment.
